The State of Kuwait pays great attention to developing its health system and is keen to implement laws and legislation that ensure the provision \u200eof high-quality medical services to citizens and residents. Believing in the \u200eimportance of monitoring private health facilities, the Ministry of Health \u200eissues decisive resolutions to close and withdraw the licenses of violating \u200efacilities, in order to ensure the safety and health of everyone.\u200e\u00a0<\/strong><\/p>\n

The competent inspection committees and the Medical Liability Authority revealed \u200eserious violations in one of the health facilities, which included practicing the \u200enursing profession without a license, and promoting home medical services \u200ethrough social media without the presence of specialized nursing staff.\u200e<\/p>\n

In the context of the State of Kuwait\u2019s concern for that health system by issuing \u200eresolutions to close that violating facility and monitoring everything that is in \u200eviolation, and within the framework of our societal and oversight role, our office \u200eobtained a final ruling convicting one of the health facilities as it was practicing the \u200esupporting profession to the medical profession without a license that allows it to \u200edo so, which is the nursing profession. By convicting the legal representative of \u200ethat treatment institution and its employees This is after he promoted that \u200einstitution affiliated with him through social media, deceiving everyone that he had \u200ecadres and supporting professions (the nursing profession) to do everything \u200enecessary for medical services at home without the patient moving to that \u200etreatment institution that was to be established.\u200e<\/p>\n

In light of this trick, the license holder claimed that he met all the conditions for \u200epracticing the nursing profession after equipping the institution with some medical \u200eequipment and medical staff, which led to the worsening of the health condition of \u200eour client for the existence of some non-specialists who were practicing the \u200eprofession with him.\u200e
\n\u200e- Since we are concerned with revealing the apparent meaning of the Lawsuit and \u200eits hidden meaning, and since we have the ability to provide evidence before the \u200ejudiciary through the methods specified by the law of the existence of that legal \u200efact, we filed an official complaint.\u200e<\/p>\n

The ruling of the first Court was to punish the Defendants with imprisonment and a \u200efine for the accusations against them, while preserving all of our client\u2019s civil rights \u200edue to the material and moral damage he suffered. This was confirmed by \u200eupholding the same ruling before the relevant Court of Appeal, so that the ruling \u200ebecame a statement of the truth. In confirmation of what was stipulated in Article \u200e\u200e(24) of Law No. 70\/2020 issued on 25\/10\/2020<\/strong> regarding the practice of the \u200emedical profession and its supporting professions and the rights of patients and \u200ethe health facility, which stipulates that it is permissible to provide medical services \u200eand home health care remotely and to benefit from the uses of artificial intelligence, \u200eadvanced technologies, modern communications, digital means and electronic \u200emedia within the framework of the necessary requirements and controls for this \u200ewith the necessity of closing clinics and shops in which violators carry out their \u200ework, and confiscating the equipment, machines, signs, etc., this ruling constitutes \u200ea victory for the health system in Kuwait, and a strong message to violators, and \u200estresses the importance of adhering to laws and requirements to preserve the \u200ehealth and safety of society. It also constitutes a deterrent to any attempts to \u200etamper with the health of citizens and residents and enhances their confidence in \u200ethe State\u2019s health system.\u200e<\/p>\n

In the end, Al-Arbash International Center for Law and Legal \u200eConsultations wishes all segments of Kuwaiti society sufficient security, \u200esafety, and physical health in light of an integrated medical system \u200esubject to all regulatory channels.\u200e<\/strong><\/p>\n
